1. Acceptance of Terms

By downloading, installing, or using JapMiner (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and JapMiner (“we,” “us,” or “our”) governing your use of the App and related services.

2. Description of Service

JapMiner is a Japanese language learning application that allows users to:

Capture Japanese text using their device's camera
Generate AI-powered flashcards with mnemonics
Study using spaced repetition algorithms
Track learning progress

3. Account Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you represent that you have parental or guardian consent.

4. Subscription and Payments

Free Tier

The free tier allows creation of up to 5 flashcards per day with full access to study features.

Pro Subscription

Pro subscription provides unlimited flashcard creation and additional features. Pricing and subscription terms are displayed within the App and on the respective App Store pages.

Billing

Subscriptions are billed through Apple App Store or Google Play Store. By subscribing, you agree to their respective terms and payment policies. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Refunds

Refund requests should be directed to Apple or Google, as they process all payments. We offer a 7-day free trial for new Pro subscribers.

5. User Content

You retain ownership of content you create using the App, including flashcards and captured images. By using the App, you grant us a limited license to:

Process your images through AI services
Store and sync your content across devices
Display your content back to you within the App

You are responsible for ensuring you have the right to capture and use any text or images you submit to the App.

6. Acceptable Use

You agree not to:

Use the App for any illegal purpose
Upload content that infringes intellectual property rights
Attempt to reverse engineer or hack the App
Use automated systems to access the App without permission
Share your account credentials with others
Abuse the AI processing system

7. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by JapMiner and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. AI-Generated Content

Mnemonics, meanings, and other content generated by AI are provided for educational purposes. While we strive for accuracy:

AI-generated content may contain errors
We do not guarantee linguistic accuracy in all cases
Users should verify information for critical applications
Content is not a substitute for professional language instruction

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAPMINER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

11. Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination:

Your right to use the App ceases immediately
We may delete your data after a reasonable period
Active subscriptions will continue until their expiration date

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the App or by email. Continued use after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
